AES Eastern Energy requests extension of exclusive plan voting period

By Caroline Salls

Pittsburgh, Nov. 27 - AES Eastern Energy, LP is requesting a third extension of its exclusive period for soliciting votes on a plan of liquidation, according to a Nov. 26 filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive solicitation period to Jan. 25 from Nov. 26.

AES Eastern Energy said it is on track to obtain confirmation of the plan filed on Nov. 14 by the end of this year.

Although it has begun soliciting votes on the proposed plan, the company said the voting deadline is Dec. 18, after the expiration of the current exclusive period.

As a result, AES Eastern Energy said it is requesting the extension "out of an abundance of caution."

A hearing is scheduled for Dec. 18.

AES Eastern Energy operates more than 1,000 megawatts of capacity at four facilities in New York. The company filed for bankruptcy on Jan. 3, 2011 under Chapter 11 case number 11-14138.
