Whittaker seeks another extension of exclusive plan periods

Olympia, Wash., Jan. 16 – Whittaker, Clark & Daniels, Inc. has asked for another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Sunday with the U.S. District Court for the District of New Jersey.

The company asked the court to extend the exclusive plan filing period through May 20 from Feb. 20 and the exclusive solicitation period through July 22 from April 22.

The company said it is now participating in mediation with the future claims representative, the official committee of unsecured creditors and other parties in interest. Additional parties may be added to the mediation in the future, to the extent helpful to facilitate a comprehensive resolution of the debtors’ liabilities.

“While the debtors are hopeful that the mediation parties will ultimately reach a workable resolution for the benefit of present and future claimants, given the complexity of the issues presented by these Chapter 11 cases and the competing interests among the parties, consensus on the terms of a Chapter 11 plan will take additional time,” the company said in the motion.

A hearing is scheduled for Feb. 13.

Whittaker, Clark & Daniels is a talc supplier based in Stamford, Conn. The company filed Chapter 11 bankruptcy on April 26, 2023 under case number 23-13575.
