GigaMonster asks for another extension of exclusive plan periods

Olympia, Wash., Sept. 11 – GigaMonster Networks, LLC is seeking another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, the company asked the court to extend the exclusive plan filing period through Dec. 12 from Sept. 13 and the exclusive solicitation period through Feb. 12 from Nov. 13.

The company said that since the first exclusivity extension order, the debtors have negotiated and obtained approval for an asset sale to Bel Air Internet LLC and Everywhere Wireless, LLC.

The debtors have also negotiated and obtained approval for several sales of de minimis assets to third-party buyers.

They have also rejected certain executory contracts and unexpired leases that are no longer needed for the debtors’ business following the SkyWire sale, continued to coordinate on various issues under the transition services agreement with SkyWire and continued to negotiate and resolve open cure issues following the court’s approval of the SkyWire sale.

The Marietta, Ga.-based internet provider filed bankruptcy on Jan. 16, 2023 under Chapter 11 case number 23-10051.
