Sandy Road says case should stay open now that assets are insured

Olympia, Wash., Sept. 26 – Sandy Road Farms, LLC responded Friday to a U.S. trustee’s motion to dismiss or convert its Chapter 11 bankruptcy case in court documents filed with the U.S. Bankruptcy Court for the District of Kansas.

As previously reported, Region 14 U.S. trustee Ilene J. Lashinsky said the debtor’s failure to maintain insurance coverage on nearly all its assets threatens the estate. A hearing on the trustee’s motion is scheduled for Wednesday.

However, the debtor said it has secured the needed insurance coverage for general liability and personal property of the estate to resolve the concerns raised in the motion.

“As such, there is no basis to dismiss or convert this Chapter 11 proceeding,” the debtor said.

The Plains, Kan.-based agricultural company filed Chapter 11 bankruptcy on Aug. 1 under case number 22-40446.
