Amsterdam House eyes fourth extension of exclusive plan periods

Olympia, Wash., Jan. 17 – Amsterdam House Continuing Care Retirement Community, Inc., which does business as the Harborside, is seeking a fourth extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Tuesday with the U.S. Bankruptcy Court for the Eastern District of New York.

Specifically, the company asked the court to extend the exclusive plan filing period through March 17 and the exclusive solicitation period through May 17.

The debtor’s case has been pending for about 10 months.

The company said that, given the significant progress the debtor has made in navigating a complex and heavily contested sale process with multiple interested bidders, the extension should be granted.

The Port Washington, N.Y.-based retirement community builder and operator filed Chapter 11 bankruptcy for the third time on March 22, 2023 under Chapter 11 case number 23-70989.
