Lucira Health seeks post-confirmation exclusivity extension

Olympia, Wash., Sept. 21 – Lucira Health, Inc. is seeking a 90-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Wednesday with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, the company asked the court to extend the exclusive plan filing period through Dec. 19 and the exclusive solicitation period through Feb. 19.

As previously reported, the company received confirmation of its Chapter 11 plan of liquidation on Sept. 19.

The company said it is seeking the extension out of an “abundance of caution.”

“Given the significant progress made to date with respect to the plan, the debtor seeks the extension described herein to preserve the status quo until the debtor emerges from Chapter 11,” the company said in the motion.

“If a competing Chapter 11 plan is filed before the effective date of the plan, there would be a disruptive and detrimental effect on the Chapter 11 case and all interested parties.”

Lucira is a medical technology company based in Emeryville, Calif. The company filed bankruptcy on Feb. 22, 2023 under Chapter 11 case number 23-10242.
