Kingswood: U.S. trustee withdraws objection to case closure motion

Olympia, Wash., April 26 – The U.S. trustee overseeing the bankruptcy case of Kansas City United Methodist Retirement Home, Inc., which does business as Kingswood Senior Living Community, withdrew his objection to the company’s motion seeking closure of the case, according to a notice filed Tuesday with the U.S. Bankruptcy Court for the Western District of Missouri.

As previously reported, on April 7, the company filed a motion seeking a final decree closing the case. The company’s Chapter 11 plan was confirmed on Nov. 10.

However, Region 13 U.S. trustee Daniel J. Casamatta had said the company had not filed a corrected report for November, a quarterly report for the first quarter of 2022, or a bank statement or other disbursement information for part of April.

The U.S. trustee said that without these reports, he couldn’t accurately calculate the amount of quarterly fees owed to him.

The debtor also hadn’t yet paid the U.S. trustee quarterly fees in full, Casamatta added.

Counsel for the U.S. trustee and the debtor communicated over the reports and payments.

Kingswood Senior Living Community is a Kansas City, Mo.-based owner and operator of a continuing care retirement community. The company filed bankruptcy on Aug. 18, 2021 under Chapter 11 case number 21-41049.
