Hytera Communications gets 120-day extension of exclusive periods

By Sarah Lizee

Olympia, Wash., April 8 – Hytera Communications America (West), Inc. secured another extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to an order filed Thursday with the U.S. Bankruptcy Court for the Central District of California.

Specifically, the court extended the plan filing period through Aug. 9 and the solicitation period through Oct. 8.

The company said in its motion that as the debtors wind down their affairs and embark on the liquidation of the remaining assets, the debtors are in the process of drafting a proposed plan of liquidation, supporting disclosure statement, and a motion for the approval of the disclosure statement and solicitation procedures.

In addition, Motorola’s counsel has indicated that it is interested in working with the debtors about formulating the terms of a consensual plan of liquidation that could provide a path to resolve the cases in a manner that is not punctuated with litigation and contested hearings, Hytera said.

The company said the extension should provide the debtors, the official committee of unsecured creditors and Motorola with the necessary time to meet and discuss the terms of a proposed plan.

Hytera is an Irvine, Calif.-based communications company. The company filed bankruptcy on May 26, 2020 under Chapter 11 case number 20-11507.
