Hytera Communications obtains 120-day extension of exclusive periods

Olympia, Wash., Oct. 7 – Hytera Communications America (West), Inc. obtained an extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to an order filed Tuesday with the U.S. Bankruptcy Court for the Central District of California.
The court extended the exclusive plan-filing period by 120 days through Jan. 11 and the solicitation period through March 12.
According to the motion, on Aug. 27, the court continued hearings on a motion from Motorola Solutions, Inc. to dismiss or suspend Hytera’s Chapter 11 proceedings and a hearing on approval of the sale of Hytera’s assets to Dec. 17.
Hytera said it has been “in extensive litigation with Motorola concerning the administration of these Chapter 11 cases and the sale of the debtors’ assets,” which has consumed the resources of the company and its professionals.
“These Chapter 11 cases have effectively been suspended until the motion to dismiss and sale motion are heard on Dec. 17,” the motion said. “In the absence of a ruling on the motion to dismiss and/or sale motion, it would be a waste of estate resources to negotiate the terms of a plan.”
Hytera is an Irvine, Calif.-based communications company. The company filed bankruptcy on May 26 under Chapter 11 case number 20-11507.
