Bosque seeks to delay disclosure statement hearing; favors mediation

By Lisa Kerner

Charlotte, N.C., Aug. 18 - Bosque Power Co. LLC asked the court to continue the Aug. 23 hearing to approve the company's disclosure statement, according to a filing with the U.S. Bankruptcy Court for the Western District of Texas.

The debtors want to engage in mediation with the pre-bankruptcy agent and the working group "with an eye toward negotiating, memorializing and pursuing confirmation of a consensual plan," the filing said.

As previously reported, the pre-bankruptcy agent and "required lenders" filed a plan of reorganization and disclosure statement for the company's bankruptcy case Aug. 2.

On July 22, the court terminated Bosque's exclusivity at the request of the pre-bankruptcy agent and lender group, allowing for the competing plan to be filed.

Bosque, a Laguna Park, Texas-based power company, filed for bankruptcy on March 24. Its Chapter 11 case number is 10-60348.
