General Wireless creditors ask court to change sale objection deadline

Pittsburgh, June 23 – The official committee of unsecured creditors for General Wireless Operations Inc., which does business as RadioShack, filed a limited objection to the proposed sale of the company’s membership interests in General Wireless IP Holdings LLC that asks the U.S. Bankruptcy Court for the District of Delaware to postpone the sale objection deadline to July 21 from July 12.

According to the objection filed Friday, the current sale objection deadline is before the July 20 auction date. However, the committee said the objection deadline should be after the auction.

“The proposed timeline not only creates the potential filing of multiple objections, one by the arbitrary July 12 deadline and another after the results of the auction are known, but requires the filing of an objection that may entirely be mooted by the results of the auction,” the committee said.

“Parties in interest should not be required to file an objection to the proposed sale before the terms of the winning bid are known.”

In addition, the committee said it is prepared to provide any comments it has well in advance of the sale hearing so that the parties can work to resolve those concerns.

Other than the objection deadline issue, the creditor group said it does not oppose the proposed sale process.

A hearing is scheduled for June 28.

General Wireless is a Fort Worth, Texas-based operator of neighborhood electronics convenience stores. The company filed bankruptcy on March 9. The Chapter 11 case number is 17-10506.
