Humble Surgical trustee looks to recover $1.02 million in transfers

Pittsburgh, Feb. 28 – Humble Surgical Hospital, LLC Chapter 11 trustee Robert E. Ogle filed a lawsuit Wednesday in an attempt to recover $1.02 million in allegedly fraudulent transfers made to River Oaks Lab, LLC by Humble, according to a filing with the U.S. Bankruptcy Court for the Southern District of Texas.

Ogle said $1 million in transfers were made to River Oaks between Aug. 2, 2016 and Feb. 22, 2017, and $16,557 in transfers were made after Humble’s bankruptcy filing.

“The trustee has reviewed HSH’s books and records and has identified no contractual basis supporting any of the transfers from HSH to River Oaks, nor has the trustee identified any consideration, value or other benefit from River Oaks to HSH in exchange for the transfers,” the complaint said.

In addition, Ogle said Humble was insolvent at the time of each transfer or was rendered insolvent as a result of the transfers.

According to the filing, the trustee asked River Oaks to return the transfers on Sept. 26, but “River Oaks failed to adequately respond to the trustee’s request.”

The Humble, Texas-based hospital provides specialized surgical and ancillary services. The company filed bankruptcy on Feb. 24, 2017 under Chapter 11 case number 17-31078.
