Kaiser Gypsum: Seattle to have two $80,952 claims tied to clean up

Pittsburgh, March 26 – Kaiser Gypsum Co., Inc. and its Hanson Permanente Cement, Inc. debtor requested court approval of a settlement reached with the City of Seattle that resolves disputes related to a five-mile stretch designated by the Environmental Protection Agency as the Lower Duwamish Waterway Superfund Site, according to a motion filed Monday with the U.S. Bankruptcy Court for the Western District of North Carolina.

In April 2014, Hanson entered into an alternative dispute resolution memorandum of agreement for itself and for Kaiser Gypsum with more than 30 participating parties, including the city, which outlined the process for allocating the response costs incurred in connection with investigation and remediation of the site.

According to the motion, Hanson and Kaiser were later deemed responsible for some undetermined portion of no less than $6.47 million in past response costs and natural resource damages and future response costs and natural resource damages.

Under the proposed settlement, the city will have an $80,952 general unsecured claim against both Hanson and Kaiser.

The company, an Irving, Texas-based manufacturer of construction and remodeling materials, filed bankruptcy on Sept 30, 2016. The Chapter 11 case number is 16-31602.
