Suntech America creditor committee looks to employ joint legal counsel

New York, Feb. 23 – Suntech America, Inc.’s official committee of unsecured creditors is seeking authorization to hire Sheppard, Mullin, Richter & Hampton LLP and Pepper Hamilton LLP as joint counsel retroactive to Jan. 22, according to separate Feb. 20 motions with the U.S. Bankruptcy Court for the District of Delaware.

If approved, Sheppard Mullin will act as the committee’s lead counsel and Pepper Hamilton will act as local Delaware counsel, but both firms advise the committee in its negotiations with Suntech and advise it during the claims analysis process and during the review of any proposed plan, sale or financing while representing the committee in court as needed.

Attorneys of Sheppard Mullin will be paid an hourly wage between $335 and $690 while Pepper Hamilton attorneys will be paid an hourly wage between $425 and $720, according to the motions.

A hearing to consider the hirings is set for March 17.

Suntech America is a San Francisco-based producer of solar panels that filed for bankruptcy on Jan. 12. The Chapter 11 case number is 15-10054.
