Marshall Broadcasting seeks exclusivity extension amid Nexstar litigation

Olympia, Wash., Sept. 30 – Marshall Broadcasting Group, Inc. requested a fourth extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a motion filed Wednesday with the U.S. Bankruptcy Court for the Southern District of Texas.

Marshall wants the court to extend its exclusive plan-filing period through Dec. 31 from Sept. 30 and the solicitation period through Feb. 28 from Nov. 30.

On March 31, the debtor commenced an adversary proceeding against Nexstar Broadcasting, Inc., seeking to avoid and recover certain transfers for the benefit of the debtor’s estate and disallow Nexstar’s claim.

The parties filed cross-motions for dispositive rulings, which the court granted in part and denied in part.

The adversary proceeding is currently in the discovery phase. The parties’ deadline to produce documents is Oct. 16, and fact discovery closes on Nov. 20.

Pretrial briefs are due on Jan. 29, with trial to commence shortly thereafter.

If Marshall prevails on its claims against Nexstar, funds will be available for distribution to the debtor’s general unsecured creditors.

Marshall is a Houston-based broadcasting company. The company filed bankruptcy on Dec. 3, 2019 under Chapter 11 case number 19-36743.
