W.R. Grace gets mediator for asbestos estimation disputes

By Caroline Salls

Pittsburgh, Sept. 13 - Roger M. Whelan was appointed mediator in W.R. Grace & Co.'s Chapter 11 bankruptcy case, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

Whelan was appointed at the request of the company and its asbestos personal injury claimants committee to mediate estimation discovery disputes.

The mediator will not report to the court. Rather, if the parties are unable to resolve the discovery dispute through mediation, they must file appropriate motions and responses regarding only the unresolved portions of the discovery requests.

W.R. Grace, a Columbia, Md.-based specialty chemicals company, filed for bankruptcy on April 2, 2001. Its Chapter 11 case number is 01-01139.
