W.R. Grace case management, questionnaire hearing rescheduled to Aug. 17

Pittsburgh, May 3 - W.R. Grace & Co.'s hearing on the case management order and proof of claim/questionnaire for the estimation of asbestos personal injury liabilities was rescheduled for Aug. 17 from July 15, according to a Tuesday order by the U.S. Bankruptcy Court for the District of Delaware.

Under the order, W.R. Grace must file a motion for approval of the case management order and questionnaire by May 9. Responses to the motion must be filed by June 9 and replies to any responses by June 21.

On April 22, the company asked the court to vacate the scheduling order that included the July 15 hearing date. W.R. Grace submitted the new scheduling order April 25.

After insurers filed an objection on March 29 to the response dates in the proposed order, W.R. Grace agreed to extend the dates for responses by three weeks.

According to Tuesday's order, on Jan. 21, the court ordered the asbestos personal injury committee, the futures claim representative and the company to negotiate a case management order to govern the estimation of the asbestos personal injury claims and the form for personal injury pre-bankruptcy claims.

The filing said the parties have been unable to reach an agreement on the case management order and questionnaire.

W.R. Grace, the Columbia, Md.-based specialty chemicals company, filed for bankruptcy over asbestos litigation on April 2, 2001. Its Chapter 11 case number is 01-01139.
