W.R. Grace CNA settlement approval order appealed by Montana claimants

By Lisa Kerner

Charlotte, N.C., Feb. 3 - Claimants injured by exposure to asbestos from the W.R. Grace & Co.'s operations in Lincoln County, Mont., appealed the order approving the company's CNA insurer coverage settlement agreement, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

BNSF Railway Co. appealed the settlement on Feb. 1.

As previously reported, in January the court approved an $84 million settlement with insurers Continental Casualty Co. and Continental Insurance Co. on their own behalf and on behalf of the "CNA companies."

W.R. Grace, a Columbia, Md.-based specialty chemicals company, filed for bankruptcy on April 2, 2001. Its Chapter 11 case number is 01-01139.
