IRS objects to Winn-Dixie disclosure statement

By Jennifer Lanning Drey

Eugene, Ore., July 25 - The United States on behalf of the Internal Revenue Service objected to Winn-Dixie Stores, Inc.'s disclosure statement, according to a Tuesday filing with the U.S. Bankruptcy Court for the Middle District of Florida.

The IRS said in the objection that the plan does not provide a complete description of assets and values.

In addition, it said it does not describe the company's performance while in Chapter 11 or the accounting and valuation methods used to produce the financial information in the statement.

The IRS holds a secured claim, priority unsecured claim and general unsecured claim against Winn-Dixie and 22 of its subsidiaries, according to the objection.

Winn-Dixie, a Jacksonville, Fla., supermarket company, filed for Chapter 11 on Feb. 21, 2005 in the U.S. Bankruptcy Court for the Southern District of New York. The case was later transferred to the U.S. Bankruptcy Court for the Middle District of Florida. Its Chapter 11 case number is 05-03817.
