Wickes former employees sue for 60 days of back pay and benefits

Pittsburgh, Feb. 28 - Former employees of Wickes Holdings, LLC filed a class-action lawsuit seeking 60 days of back pay and benefits for alleged violations of employee rights and labor laws connected to the workers' termination, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

The class-action plaintiffs said they were terminated as part of a mass layoff in February without the required 60-day advance written notice on Feb. 4.

The plaintiffs alleged that the termination constituted a violation of the Worker Adjustment and Retraining Notification Act.

Since the plaintiffs are seeking damages from the period of time after the company filed for bankruptcy, they said their claim should count as administrative priority.

Wickes, a Wheeling, Ill., furniture retailer, filed for bankruptcy on Feb. 3. Its Chapter 11 case number is 08-10212.
