Uni-Marts dealers object to exclusivity extension

By Caroline Salls

Pittsburgh, Feb. 17 - A group of Uni-Marts, LLC dealers objected Tuesday to the company's request for an extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a filing with the U.S. Bankruptcy Court for the District of Delaware.

According to the objection, Uni-Marts has "not demonstrated any need for exclusivity or any reasonable likelihood that a feasible Chapter 11 plan can be confirmed."

Although the company claims that it has worked with its financial advisers to prepare a detailed analysis of expected sales, operating margins and overhead to determine the feasibility of a stand-alone plan, the dealers said no such analysis has been provided to the dealers, their counsel or the court.

The objecting dealers are AAA Convenience, Inc., Kemps Corner Corp., 601 Church Street Corp., 1204 Sans Souci Parkway Corp. and Charan Trading Corp.

Uni-Marts, a State College, Pa.-based convenience store operator, filed for bankruptcy on May 29, 2008. Its Chapter 11 case number is 08-11037.
