Swisher Hygiene amends revolver again for more time to file 10-K, 10-Q

Madison, Wis., May 17 - Swisher Hygiene Inc. entered into a third amendment to its credit agreement dated March 30, 2011, according to an 8-K filing with the Securities and Exchange Commission. The agreement provided for a $100 million senior secured revolving credit facility due July 31, 2013 with Wells Fargo Bank, NA as administrative agent.

The third amendment, dated May 15, grants an extension for the delivery of the company's financial statements for the fiscal year ended Dec. 31 until the earlier of the date on which the company delivers those statements to the SEC and May 31.

The company had already entered into a second amendment on April 12 to extend the delivery of the financial statements until the earlier of the date on which the company delivers those statements to the SEC and May 15.

The third amendment also waives any default or event of default that may exist if the company fails to file its annual report for the year ended Dec. 31 by April 16 and its quarterly report for the quarter ended March 31 by May 21, as long as the company files a form 10-K and a form 10-Q by May 31.

Swisher is a Charlotte, N.C.-based provider of hygiene and sanitation solutions.
