SunEdison committee applies to hire Weil, Gotshal & Manges as counsel

New York, May 19 – SunEdison, Inc.’s committee of unsecured creditors applied to retain and employ Weil, Gotshal & Manges LLP as its counsel, according to a filing Thursday with the U.S. Bankruptcy Court for the Southern District of New York.

The employment is retroactive to April 29.

Weil, Gotshal & Manges will

• Advise the committee on its powers and duties under bankruptcy code and laws;

• Consult with the committee, debtors and U.S. trustee on administration of these cases;

• Attend meetings and negotiate with the debtors’ representatives and other related parties;

• Investigate and analyze prepetition acts and conduct, including inter-debtor and intercompany transfers;

• Analyze the assets, liabilities and financial condition of the debtors, the operation of the debtors’ businesses, the desirability of the continuance of businesses, proposals to restructure the debtors’ operations and any matters relevant to these cases in the event and to the extent required by the creditors’ committee;

• Assist and advise in connection with all relief sought by the debtors, including the evaluation of debtor-in-possession financing and other financing alternatives;

• Assist and advise the committee in connection with any asset sales;

• Assist and advise the committee in the review, analysis and negotiation of any Chapter 11 plans of reorganization or liquidation that may be filed and assist the committee in the review, analysis and negotiation of the disclosure statement;

• Take necessary actions to protect and preserve the interests of the committee, including investigating and prosecuting of actions, if appropriate, negotiations concerning all litigation in which the debtors are involve and if appropriate, review and analyze claims filed against the debtors;

• Prepare, on behalf of the committee, all necessary motions, applications, answers, orders, reports, replies, responses and other legal papers; and

• Appear in court; and perform other duties.

Attorneys for Weil, Gotshal & Manges charge between $490 and $1,350 per hour.

Based in Maryland Heights, Mo., SunEdison operates renewable power plants. It filed for bankruptcy on April 21 under Chapter 11 case number 16-10992.
