Sears seeks two-month exclusivity extension to prosecute amended plan

Pittsburgh, Aug. 7 – Sears Holdings Corp. is seeking an extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a motion filed Tuesday with the U.S. Bankruptcy Court for the Southern District of New York.

Sears is asking the court to extend its exclusive plan-filing period by two months through Oct. 14 and the solicitation period through Dec. 16.

According to the motion, the hearing on confirmation of the company’s second amended Chapter 11 plan is scheduled for Aug. 16, four days after the current exclusive filing period expires on Aug. 12.

“Accordingly, out of an abundance of caution, by this motion, the debtors are seeking another modest two-month extension of the exclusive periods to complete prosecution of the plan,” Sears said.

A hearing is scheduled for Aug. 22.

Sears is a retailer based in Hoffman Estates, Ill. The company filed bankruptcy on Oct. 15, 2018 under Chapter 11 case number 18-23538.
