Quigley tort victims committee appeals denial of plan confirmation

Charlotte, N.C., Dec. 31 - Quigley Co. Inc.'s informal committee of tort victims appealed the court order denying confirmation of the company's plan of reorganization, according to a Friday filing with the U.S. Bankruptcy Court for the Southern District of New York.

On Dec. 22 the Region 2 U.S. Trustee asked the court to dismiss Quigley's Chapter 11 bankruptcy case because there has been no change in the company's operations or circumstances since the court denied confirmation of Quigley's fourth plan in September. Also, negotiations between an informal creditors committee and parent company Pfizer Inc. have been unsuccessful.

A hearing on the case dismissal motion is scheduled for Jan. 13.

The ad hoc committee of tort victims previously asked the court to dismiss Quigley's bankruptcy case.

Pfizer Inc., in October, also appealed the order denying the confirmation.

The current members of the tort ad hoc committee are Weitz & Luxenberg, PC, Cooney & Conway and the Law Offices of Peter G. Angelos, PC, who collectively represent more than 34,100 individual asbestos claimants, the filing said.

Quigley, a unit of Pfizer Inc., filed for bankruptcy on Sept. 3, 2004. Its Chapter 11 case number is 04-15739.
