Parmalat to get examiner

By Jeff Pines

Washington, June 4 - Parmalat USA Corp. will get an examiner, according to a court order filed with the U.S. Bankruptcy Court for the Southern District of New York Friday.

The examiner's role will be to examine whether the strategy for inter-company and third-party claims used by the company and the creditors' committee favors anyone.

The initiative for appointing an examiner came from Friendship Dairies Inc. and Perry's Ice Cream Inc., both of which are creditors. Friendship has claims of about $15,000 and Perry's of about $330,000.

The examiner will have two weeks from his or her appointment being approved by the court to finish the investigation.

Parmalat USA filed for bankruptcy on Feb. 24. Its Chapter 11 case number is 04-11139.
