Sun Microsystems to respond to second request in merger with Oracle
By Lisa Kerner
Charlotte, N.C., June 29 - Sun Microsystems, Inc. said it received a request for additional information from the Department of Justice on Friday regarding the company's proposed merger with Oracle Corp.
According to Sun, it is gathering information in response to the second request and "working cooperatively" with the Justice Department to resolve the issue.
The second request will extend the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act of 1976, Sun said.
In April, Oracle announced it agreed to acquire Sun for $9.50 cash per share in a deal valued at approximately $7.4 billion including debt.
Sun shareholders will vote on the proposed merger on July 16.
Oracle is a Redwood City, Calif.-based enterprise software company.
Sun is a Santa Clara, Calif., networking computing technologies company.
