Former Fresh & Easy 30-day exclusivity extension to settle claims OK'd

New York, April 3 - Old FENM Inc., formerly Fresh & Easy Neighborhood Market Inc., obtained a second extension of its exclusive plan of reorganization filing and solicitation periods, according to a Thursday order with the U.S. Bankruptcy Court for the District of Delaware.

The company requested a 60-day extension, but was granted an extension of 30 days, according to the order.

The company's filing period is extended through April 30 from April 1 and its solicitation period through June 29 from May 30.

As previously reported, the company sought the extension to allow its government bar date to pass and to resolve the employee claims filed against, allowing the proposal of a fully consensual Chapter 11 plan, according to the motion.

If the company requires an additional extension, they must inform the committee by April 17 of its intent and any motion will be considered in an omnibus hearing scheduled for April 22, according to the order.

Fresh & Easy, a Wilmington, Del.-based grocery store chain, filed for bankruptcy on Oct. 1. The Chapter 11 case number is 13-12569.
