NorthWestern seeks extension to its solicitation period

By Jeff Pines

Washington, June 1 - NorthWestern Corp. said it needs more time to solicit votes for its reorganization plan.

In a filing Tuesday with the U.S. Bankruptcy Court for the District of Delaware, the company asked the court to extend the exclusive period to solicit votes to Sept. 30 from July 12.

The court approved NorthWestern's disclosure statement on May 26 and the statement sets an Aug. 2 deadline to solicit votes.

The Sioux Falls, S.D.-based utility noted that its case is large and complex since it provides services to 608,000 customers in three states, that it has made progress in resolving its case and that another extension will not coerce creditors into voting for the plan. The company added it has kept its post-petition lenders, the U.S. trustee's office and the official creditors' committee fully informed.

NorthWestern has asked for two previous extensions.

A June 21 hearing is scheduled.

It filed for Chapter 11 on Sept. 14. NorthWestern's Chapter 11 case number is 03-12872.
