Movie Gallery wants bankruptcy court to extend exclusivity periods

Charlotte, N.C., July 23 - Movie Gallery, Inc. requested an extension to its exclusive periods to file a plan of liquidation and solicit votes on the plan, according to a Friday filing the U.S. Bankruptcy Court for the Eastern District of Virginia.

The company wants to extend its exclusive plan-filing period to Oct. 31 from July 31 and the solicitation period to Dec. 30 from Sept. 30.

Movie Gallery filed its plan on July 13.

"Extending the exclusive periods will permit the debtors to pursue confirmation of the fully consensual plan that has been developed with the input and cooperation of the debtors' major constituencies without unwarranted interference from any dissident party attempting to derail the plan process for its own purposes," the motion said.

In May, the court extended the exclusive filing period to July 31 from June 2 and the solicitation period to Sept. 30 from Aug. 1.

Movie Gallery, a Wilsonville, Ore.-based video and game rental company, filed for bankruptcy on Feb. 2. Its Chapter 11 case number is 10-30696.
