Movie Gallery seeks four-month exclusivity extension to avoid plan confirmation delays

Pittsburgh, Jan. 10 - Movie Gallery, Inc. requested a four-month extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a motion filed Wednesday with the U.S. Bankruptcy Court for the Eastern District of Virginia.

Specifically, the company wants to extend its exclusive plan-filing period to June 13, 2008 from Feb. 13 and the solicitation period to Aug. 13, 2008 from April 13.

According to the motion, although the company has already filed its plan of reorganization, the current exclusivity deadlines would fall in the middle of the plan confirmation process, "presenting a risk of undue interference and disruption to the confirmation process."

If any objections are raised to the exclusivity extension, a hearing will be held on Jan. 29.

Movie Gallery, a Dothan, Ala.-based video rental company, filed for bankruptcy on Oct. 16. Its Chapter 11 case number is 07-33849.
