Midway Games eyes exclusivity extension in case plan is not confirmed

Pittsburgh, May 14 - Midway Games Inc. requested an eighth extension to its exclusive periods for filing and soliciting votes on a plan of liquidation, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive filing period to July 13 from May 14 and the solicitation period to Sept. 11 from July 13.

Although it has already filed and solicited votes on a plan, Midway said it would need more time to prepare and solicit acceptances of a second plan if the original is not confirmed at the May 21 plan hearing.

A hearing on the exclusivity extension is scheduled for June 23.

Midway Games, based in Chicago, is a developer and publisher of interactive entertainment software for videogame systems and personal computers. The company filed for bankruptcy on Feb. 12, 2009, and its Chapter 11 case number is 09-10465.
