Midway Games seeks three-month exclusivity extension to complete sale

By Caroline Salls

Pittsburgh, June 8 - Midway Games, Inc. is seeking an extension to its exclusive periods to file a plan of reorganization and to solicit votes on the plan, according to a Friday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive plan-filing period to Sept. 10 from June 12 and the solicitation period to Nov. 9 from Aug. 11.

According to the filing, once Midway's asset sale has been approved, it will be in a position to finalize negotiations with its creditor constituencies on the terms of a proposed plan.

The sale hearing is scheduled for July 1. The exclusivity extension hearing is also scheduled for that date.

Midway Games, based in Chicago, is a developer and publisher of interactive entertainment software for videogame systems and personal computers. The company filed for bankruptcy on Feb. 12, and its Chapter 11 case number is 09-10465.
