Merisant requests 60-day exclusivity extension to negotiate plan

New York, Oct. 21 - Merisant Worldwide, Inc. requested a third extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive plan-filing period by 60 days, to Dec. 19 from Oct. 20, and the solicitation period also by 60 days, to Feb. 17 from Dec. 19.

A hearing has been scheduled for Nov. 18.

Since filing its disclosure statement and plan of reorganization in September, the company said it has been working "to gain additional creditor support for the plan" as well as working on an amended plan and disclosure statement, which was filed Oct. 20, according to the motion.

The company said it anticipates that "the disclosure statement will be approved, and that [it] can begin solicitation on [its] plan soon after the disclosure statement hearing," which is scheduled for Oct. 23. The plan confirmation hearing has been scheduled for Dec. 16.

Merisant, a Chicago-based marketer of low-calorie tabletop sweeteners, filed for bankruptcy on Jan. 9, 2009. Its Chapter 11 case number is 09-10059.
