MAXjet requests exclusivity extension to continue negotiations with creditors committee

By Jennifer Lanning Drey

Portland, Ore., Aug. 11 - MAXjet Airways, Inc. requested an extension to its exclusive periods to file a Chapter 11 plan and solicit votes on the plan, according to a Friday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend the exclusive plan-filing period to Oct. 20 from Aug. 20 and the solicitation period to Feb. 17, 2009 from Oct. 20.

MAXjet said it has drafted a Chapter 11 plan and related disclosure statement but is still negotiating the documents with its official committee of unsecured creditors.

The company said it requested the additional time for the solicitation period because it does not expect a plan confirmation hearing to occur until at least October 2009.

A hearing on the exclusivity motion has been scheduled for Aug. 27.

MAXjet was an all-business-class airline based in Dulles, Va. The company filed for Chapter 11 bankruptcy on Dec. 24, 2007. Its case number is 07-11912.
