MACH Gen gets court authorization to hire two firms as legal counsel

New York, April 11 - MACH Gen, LLC won court approval to hire Milbank, Tweed, Hadley & McCloy LLP and Richards, Layton & Finger, PA as legal counsel in its continuing Chapter 11 cases, according to two Thursday orders with the U.S. Bankruptcy Court for the District of Delaware.

Both hirings are retroactive to March 3.

As previously reported, Milbank has been the company's legal representative "for almost a decade in matters related and unrelated to Chapter 11 cases," according to the motion.

The court also approved the company's proposed evergreen retainer, or a monthly renewal of the retainer, for its employment of Richards, Layton & Finger to act as co-counsel and assist the company in "the myriad issues" related to its Chapter 11 case.

Both firms will advise the company in its rights, powers and duties as debtors in possession, tax matters, obtaining cash collateral and its preservation of the estate, along with conducting all legal and administrative requirements of the company and representing it in court proceedings.

MACH Gen, a Silver Spring, Md.-based portfolio of power-generation assets, filed bankruptcy on March 3. The Chapter 11 case number is 14-10461.
