MACH Gen requests court approval to employ two firms as legal counsel

By Kali Hays

New York, March 24 - MACH Gen, LLC requested approval to hire Milbank, Tweed, Hadley & McCloy LLP and Richards, Layton & Finger, PA as legal counsel in its continuing Chapter 11 cases, according to two Friday filings with the U.S. Bankruptcy Court for the District of Delaware.

The company requested that both hirings be retroactive to March 3.

Milbank has been the company's legal representative "for almost a decade in matters related and unrelated to Chapter 11 cases," the filing stated.

The company has requested an evergreen retainer, or a monthly renewal of the retainer, for its employment of Richards, Layton & Finger to act as co-counsel and assist the company in "the myriad issues that may arise in these Chapter 11 cases."

Both firms will advise the company in its rights, powers and duties as debtors in possession, all tax matters, in obtaining cash collateral and its preservation of the estate, along with conducting all legal and administrative requirements of the company and representing it in court proceedings.

A hearing is scheduled for April 11.

MACH Gen, a Silver Spring, Md.-based portfolio of power-generation assets, filed bankruptcy on March 3. The Chapter 11 case number is 14-10461.
