Lyondell debtor sues for $11.34 million in contract payments

By Caroline Salls

Pittsburgh, Feb. 9 - Lyondell Chemical Co. debtor Houston Refining, LP filed a lawsuit Monday against Koch Supply & Trading, LP in an attempt to recover $11.34 million allegedly owed to Houston Refining for products delivered through Jan. 6, according to a filing with the U.S. Bankruptcy Court for the Southern District of New York.

Houston Refining said Koch owes the money in connection with feedstock and refined products sale agreements reached in December 2008.

However, Koch has allegedly refused to pay for the deliveries in question, according to the complaint.

Lyondell is a U.S. subsidiary of LyondellBasell, a Netherlands-based polymer, petrochemicals and fuels company. LyondellBasell's U.S. operations and one of its European holding companies filed for bankruptcy on Jan. 6. The Chapter 11 case number is 09-10023.
