Longview Power soliciting plan votes, requests exclusivity extension

Pittsburgh, Sept. 29 – Longview Power, LLC is seeking an extension of its exclusive periods for filing and soliciting votes on a plan of reorganization, according to a Monday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive filing period through Dec. 31 from Sept. 30 and the solicitation period through March 2 from Dec. 1.

The company said it is focused on obtaining confirmation of the amended plan for which it is soliciting votes.

To prosecute the amended plan, Longview said it is engaged in crucial litigation with First American Title Insurance Co. regarding the company’s property interest in, and the availability of coverage under, a title insurance policy.

In addition, Longview said it is continuing to pursue mediation with contractors, backstoppers, and First American to resolve the contingencies that remain in its Chapter 11 cases.

A hearing is scheduled for Oct. 30.

Longview, an integrated power generation enterprise based in Maidsville, W.Va., filed for bankruptcy on Aug. 30, 2013. The Chapter 11 case number is 13-12211.
