The sale, subject to a 30-day due diligence period, is expected to close in late October.

As previously reported, the property being sold is owned by Apple Creek Estates, LLC and consists of phases one through nine of the Apple Creek Estates subdivision.

Kirk, an employee-owned homebuilder based in Streamwood, Ill., filed for bankruptcy on May 12, 2009. Its Chapter 7 case number is 09-17236.
