KB Toys gets extensions on exclusivity

Washington, Sept. 28 - KB Toys Inc. obtained extensions to its exclusivity giving it until Nov. 17 to file a reorganization plan and until Jan. 16 to solicit votes for the plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company's exclusive right to file a plan was previously scheduled to end Sept. 27.

According to paperwork previously filed with the court, the Pittsfield, Mass.-based toy retailer asked the court to extend its exclusive right to file a plan to Jan. 31 and to give it until April 1, 2005 to solicit votes.

The order did not explain the judge's decision to shorten the extensions from what KB Toys had requested.

KB Toys filed for bankruptcy on Jan. 14, 2004. Its Chapter 11 case number is 04-10120.
