JER Investors Trust asks bankruptcy court for exclusivity extension

Olympia, Wash., April 26 – JER Investors Trust Inc. is seeking an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Thursday with the U.S. Bankruptcy Court for the District of Delaware.

The company asked the court to extend the exclusive plan filing period through July 29 and the exclusive solicitation period through Sept. 24.

As previously reported, the company has already filed a plan and received conditional approval of the disclosure statement. The combined hearing on confirmation of the plan and final approval of the disclosure statement is scheduled for May 16.

The company said it filed the exclusivity motion out of an abundance of caution to protect its rights while it seeks approval of the plan and in case the confirmation hearing is adjourned or the plan is denied for any reason.

The White Plains, N.Y.-based mortgage real estate investment trust filed bankruptcy on Dec. 29 under Chapter 11 case number 23-12109.
