Hussey Copper seeks extension of exclusive period to file its plan

By Jim Witters

Wilmington, Del., May 7 - Hussey Copper Corp. is seeking a 60-day extension of its exclusive periods for filing a Chapter 11 plan and soliciting acceptances of that plan, according to documents filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

The motion would extend the exclusive period for filing a plan through July 4 from May 5 and the period for soliciting votes through Sept. 2 from July 4.

As previously reported, the company submitted a Chapter 11 plan on May 4.

"To ensure that these Chapter 11 cases continue to progress in an effective and efficient manner, the debtors seek the requested extensions so that they can continue to work towards a consensual Chapter 11 plan for each of the debtors and, at the same time, resolve issues arising with respect to the reconciliation of claims asserted against the debtors' estates and the efficient reorganization or wind down of the debtors' operations," the motion states.

A hearing on the request is scheduled for 11 a.m. ET on May 21.

Hussey, a Leetsdale, Pa.-based copper products manufacturer now known as HCL Liquidation Ltd., filed for bankruptcy on Sept. 27, 2011. Its Chapter 11 case number is 11-13010.
