Hawaiian Telcom looks to move bankruptcy case to Hawaii court

By Caroline Salls

Pittsburgh, Dec. 15 - Hawaiian Telcom Communications, Inc. said it would ask the U.S. Bankruptcy Court for the District of Delaware Monday to approve a stipulation with the state of Hawaii under which the company's Chapter 11 case would be transferred to the U.S. Bankruptcy Court for the District of Hawaii.

According to a company news release, Hawaiian Telcom initially filed its case in Delaware because it is incorporated under Delaware law and the Delaware court is in close proximity to the company's bankruptcy advisers.

However, following discussions with various constituents, Hawaiian Telcom said it has agreed that it is appropriate to move the Chapter 11 cases to the Hawaii bankruptcy court.

The company said it expects the hearing on approval of the stipulation to be scheduled for Dec. 23.

Hawaiian Telcom, Inc., a Honolulu-based telecommunications provider, filed for bankruptcy on Dec. 1. Its Chapter 11 case number is 08-13086.
