New York judge allows new Global Aviation case to stay in Delaware

Wilmington, Del., Nov. 21 - Global Aviation Holdings, Inc.'s new bankruptcy case will remain in Delaware, despite the fact that the company's 2012 case remains open in the U.S. Bankruptcy Court for the Eastern District of New York, according to debtors attorney Christopher Ward.

New York bankruptcy judge Carla E. Craig made the ruling during a Nov. 20 hearing.

As previously reported, Delaware judge Mary F. Walrath declined to hear the new case without an order from judge Craig under Rule 1014 of the bankruptcy code, which governs jurisdiction and the transfer of cases.

Judge Craig granted temporary relief so the case could proceed Nov. 14 with first-day motions and interim approval of $36 million in debtor-in-possessing financing.

Global Aviation's Chapter 11 case remains open in New York, though the plan was confirmed and became effective in February.

Global Aviation is a Peachtree City, Ga.-based provider of charter air transportation for the U.S. military and of commercial global passenger and cargo air transportation services. The Chapter 11 case number is 13-12945. The case in the Eastern District of New York is number 12-40783.
