Global Aviation seeks OK to make plan changes without new creditor vote

Wilmington, Del., Jan. 24 - Global Aviation Holdings Inc. is seeking approval for "immaterial modifications" to its first amended joint plan of reorganization approved on Dec. 6 and for amending the confirmation order to apply to the revised plan, according to documents filed Wednesday with the U.S. Bankruptcy Court for the Eastern District of New York.

The change to the plan involves $10 million to be provided by the exit lender, rather than by the debtor-in-possession lender.

"As a result, the new first-lien loan, provided in satisfaction of the DIP claims and roll-up claims, will be reduced from $95 million to $85 million under the plan," the motion states.

Global Aviation is asking the court to allow the change without the need for soliciting votes on the revised plan.

No hearing on the company's request has been scheduled.

Global Aviation is a Peachtree City, Ga.-based provider of charter air transportation for the U.S. military and of commercial global passenger and cargo air transportation services. The company filed for bankruptcy on Feb. 5, 2012 under Chapter 11 case number 12-40783.
