Garden Fresh wins exclusivity extension to evaluate plan alternatives

Pittsburgh, Feb. 7 – Garden Fresh Restaurant Corp. obtained an extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to an order filed Tuesday with the U.S. Bankruptcy Court for the District of Delaware.

The company’s exclusive filing period was extended by 90 days through May 1 and the solicitation period through June 30.

During the four months since the filing of its Chapter 11 cases, Garden Fresh has devoted substantial resources to addressing critical case-management issues while simultaneously conducting a sale process, the company told the court.

“Under these circumstances, the debtors submit that the requested extensions are both appropriate and necessary to afford the debtors sufficient time to adequately evaluate their alternatives for a plan in these Chapter 11 cases,” the motion said.

Based in San Diego, Garden Fresh operates 128 restaurants in 15 states under two brand names: Souplantation and Sweet Tomatoes. The company filed bankruptcy on Oct. 3 under Chapter 11 case number 16-12174.
