Court grants Allen Family Foods 90-day extension of exclusive periods

By Caroline Salls

Pittsburgh, Sept. 12 - Allen Family Foods, Inc. obtained a 90-day extension on its exclusive periods for filing a Chapter 11 plan and for soliciting plan acceptances, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company's exclusive period for filing a Chapter 11 plan was extended to Nov. 29 from Aug. 31. The vote solicitation period was extended to Jan. 29 from Oct. 31.

Allen Family Foods said in the motion that it needs the additional time because it has been focused on transferring operations to Harim USA Ltd. The sale closed in September 2011.

The company and the official committee of unsecured creditors have now "turned their attention to analyzing the full scope of claims that have been filed against their estates and drafting a plan of liquidation," the motion stated.

Allen Family Foods, a Seaford, Del.-based poultry producer, filed for bankruptcy on June 9, 2011. Its Chapter 11 case number is 11-11764.
