EZ Lube seeks to lengthen exclusivity as initial extension nears end

New York, Aug. 4 - EZ Lube, LLC requested a 90-day extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company was granted a four-month extension in May, after a stalking horse bidder withdrew its bid, but the exclusivity for filing a plan expires Aug. 6.

EZ Lube wants to extend its exclusive plan-filing period to Nov. 5 from Aug. 6 and the solicitation period to Jan. 4 from Oct. 6.The company said its case was complicated by the termination of the bid from the stalking horse purchaser, and more time is needed to negotiate with creditors.

A hearing is scheduled for Sept. 9.

EZ Lube, a Santa Ana, Calif.-based quick lube operator, filed for bankruptcy on Dec. 9, 2008. Its Chapter 11 case number is 08-13256.
