Smith Management appeals rejection of Exide's proposed plan

Washington, Jan. 12 - Smith Management LLC appealed the rejection of Exide Technologies' fourth amended joint plan of reorganization, according to a filing with U.S. Bankruptcy Court for the District of Delaware.

In addition, Smith Management appealed the opinion that any settlement made to holders of the 2.9% convertible notes would be based upon the existence of a senior subordinated obligations claim and would fall within payments prohibited by section 4.02 of the 2.9% notes, the filing said.
